Internet Privacy Fight Continues

Dear Erick, Thanks to your quick action this week, C4L helped generate intense heat on a bill once thought to be guaranteed smooth passage. As it turns out, the Republican Leadership was so “confident” in H.R. 3523, the "Cyber Intelligence Sharing and Protection Act" (CISPA), that they had to ram it through at the last minute Thursday night after an entire week of portraying the vote as taking place today. Ultimately, the legislation passed 248-168. House Leadership knew the opposition to CISPA was growing in both numbers and intensity as groups like C4L got the word out on their latest attack on our privacy. So they were only able to pass it after adopting 11 amendments on the House floor to tweak the language. If a bill needs to be changed that much, it’s pretty obvious it should go back to the drawing board instead of on to the Senate. Though we fell short of stopping CISPA in the House, the vote was much closer than it was expected to be even a week ago, and I again thank you for your response to our calls for action. With so many amendments being adopted just before the rushed vote on final passage, it was not possible for representatives to get a full picture of what the bill will do until after they passed it. I’m sure you remember Nancy Pelosi’s famous proclamation, “We have to pass [ObamaCare] so you can find out what’s in it.” Though an examination of the Frankenstein legislation CISPA became reveals some useful narrowing of certain language, the final bill still contains broad provisions that could open the floodgates for what government can see about our online activity. And, despite so many amendments, CISPA still contains the “notwithstanding any other provision in law" clause that trumps current privacy laws and the immunity guarantee that allows private companies to get off scot-free if they misuse our information or falsely accuse us. The battle to guard our privacy online now turns to the Senate, where CISPA faces an uncertain future. But it’s a guarantee that any refusal on Senator Harry Reid’s part to bring CISPA up for a vote won’t be because of a love for liberty. Instead, a coalition of senators led by Joe Lieberman and Susan Collins are promoting their own legislation that can only be described as CISPA on steroids. But friends of freedom have a powerful ally in Senator Rand Paul as we oppose this bill, and C4L will need your help again to provide him with the critical grassroots reinforcements necessary to guard our privacy and civil liberties. Though it can seem discouraging when a bill so fiercely attacking our rights passes a chamber of Congress, you and I must never let such news knock us out of the fight. The statists know which way the wind is blowing in this country, and that’s why they’re pulling out every possible stop to enforce their agenda. If your representative voted for CISPA, I urge you to call Congress and let them know you will be sure to tell your fellow constituents about their refusal to stand for freedom. If your representative voted against CISPA, I hope you will remind them that we expect loyalty to the Constitution on every other vote, as well. As we look ahead, let us redouble our resolve and press on in defense of liberty. Congress Set to Invade Your Privacy Again

Dear Erick, On Thursday, Congress is scheduled to begin consideration of H.R. 3523, the "Cyber Intelligence Sharing and Protection Act of 2011" (CISPA). This bill is the next great threat to our privacy over the Internet, but unlike the fight against SOPA and PIPA, Internet giants like Facebook and Twitter are openly supporting CISPA. And as I write this, House Leadership is quietly working hard to gain your representative's support, including holding classified, "members only" meetings to make their case. I'm counting on your immediate action to halt this bill's progress and protect our privacy from the government's ever-expanding reach. CISPA is promoted as a harmless bill to facilitate the voluntary exchange of information between the private sector and government intelligence agencies. Your Privacy is in Jeopardy

Dear Erick, This coming week, Congress is set to take up another so-called "cybersecurity" bill, H.R. 3523, the "Cyber Intelligence Sharing and Protection Act of 2011" (CISPA). And this time, many of those who joined us to stop SOPA and PIPA are supporting this legislation. So only the immediate action of you and your fellow C4L members can help protect our privacy from the government's ever-expanding reach. After our victory over SOPA/PIPA, I wrote to you in late February about the need to stay vigilant against Congress' attempts to assert more control over the Internet. Well, since then, Republicans and Democrats have introduced at least four major "cybersecurity" bills. Expanding government power is always bipartisan. CISPA, sponsored by Rep. Mike Rogers (MI-8), is promoted as a harmless bill that will enable voluntary "information sharing" between private corporations and government agencies in the name of "cybersecurity." Unfortunately, it would allow the transfer of vast amounts of data, including information like your Internet browsing history or email content, to any agency in the federal government, including non-civilian agencies such as the National Security Agency or the Department of Defense Cyber Command. One major problem with these alleged "cybersecurity" bills is their overly broad focus on what information private companies are encouraged to share with federal agencies. CISPA currently contains no incentive for private companies like Facebook or Google to remove personally identifiable information from data they share. In addition, the way this legislation is drafted, it currently overrides privacy presumptions found in the Electronic Communications Privacy Act, the Foreign Intelligence Surveillance Act, and the Communications Act regarding the privacy of an individual's online communications and related records. Essentially, CISPA would deem all existing privacy laws null and void for "cybersecurity" purposes. Once the government has this information, there are no meaningful restrictions on its use, as its only qualifier is that it must be related to "cybersecurity" or to protect "national security." As C4L members know too well, "national security" has become a catch-all excuse for government powergrabs since 9/11. Finally, while the bill includes a requirement for the Director of National Intelligence's Inspector General to issue annual reports on how the government is using the information shared under the bill, such reports would only be provided to congressional intelligence committees. These reports would not constitute meaningful restrictions or do anything to dissuade the misuse of personal information shared under CISPA. As I hinted at earlier, unlike the January 18 "Internet blackout" over SOPA and PIPA, this time Internet giants like Facebook and Twitter are openly supporting CISPA, along with powerful special interest groups like the US Chamber of Commerce. In other words, don't expect the cavalry to back us up on this one. And House Leadership is currently engaged in a full-court press effort to get your representative to support H.R. 3523. Sources on the Hill have informed us of "members only" meetings, where representatives are being encouraged to vote for CISPA as a "national security" issue addressing a "credible" "cybersecurity threat." I'm sure it's only a coincidence that this briefing comes conveniently just ahead of when the establishment wants to ram something through. In the face of such longshot odds, without your immediate action, I can't promise that we have even the slightest chance of beating back this egregious invasion of your privacy. But, I've seen the power the liberty movement can have when it speaks out with a unified voice. And you better believe members of Congress have taken notice, too. They’re Scrambling

Heard the News?

Dear Erick, Have you heard the news yet? Yesterday, Minnesota held three district conventions. Our campaign swept all three - winning nine delegates to the Republican National Convention in Tampa! And in Colorado, I picked up 12 delegates and 13 alternate delegates, as my campaign pushed a "unity slate" with Rick Santorum's supporters that ended up with 20 total delegates - while Mitt Romney only walked away with 16 delegates! The Denver Post even called it a "stunning upset." With Rick Santorum having suspended his campaign, I'm sure we can persuade more of those delegates over to our side. I'm also proud that two of my Colorado supporters will serve on the Rules Committee at the National Convention. This simply confirms what I've been saying all along - this race will be won convention by convention, one delegate at a time. And while my opponents were focused on winning straw polls, my campaign was laying the foundation for the successes we're experiencing now. An Easy Endorsement

Dear Erick, It isn't often that an endorsement is this easy for me.  The candidate I am writing to tell you about deserves your support right now.  He is in a Republican primary to be the next Congressman from the 4th district of Kentucky.  And he can win.  He has the right message, the right principles, and is running in a district that my son Rand carried in both his primary and his general election by wide margins. His name is Thomas Massie, and I am proud to endorse him today and to tell you more about him in the hope that you will join me in supporting his candidacy. Thomas Massie has been a part of our Revolution for years.  His political beliefs and personal principles led him to a strong adherence to liberty, and he has worked to show his family, neighbors, and friends the path to freedom. Thomas grew up in Kentucky, in the area where he now resides with his wife and four children.  He left briefly to attend MIT and to start a career as an inventor and entrepreneur.  Thomas knows what it is like to try to get an idea through the business and governmental mazes set up for job creators.  He has been successful for himself, his family, his investors, and his workers. Thomas eventually decided to move back to Lewis County, Kentucky, where he grew up - wanting his kids to grow up there, too. It was from there that he was such a strong supporter of my 2008 campaign, as well as the beginning of Campaign for Liberty.  And he was invaluable to my son Rand when he ran for office, taking an early interest in Rand's race, helping him meet folks in his area, raising money, campaigning - you name it, Thomas did it for Rand's race in 2010. Thomas also saw that there was a problem in his local government.  Spending and regulations continued to grow, teaming up to put a stranglehold on his local economy.  So Thomas decided to do something about it. He ran against an incumbent Republican in a primary for Judge Executive of his county (the head of the county government in Kentucky) and surprised everyone by beating him 2-1.  He ended up winning the general election and marched into office determined to save his county's finances.  In just a few short months, Thomas had found enough in savings in his small county to pay his own county salary for three years! Principles put into quick action! Thomas has also made all the right kind of enemies, both as an activist and a county executive.  The establishment can't stand him.  The tax-and-spenders fear him.  The people Rand refers to as "the beseechers" don't even bother with him. Sometimes your enemies tell you just as much about you as your friends. Thomas is the real deal.  He will only vote for constitutional laws, and he will fight to restore our lost rights if he is elected to Congress.  I've seen his agenda, and it is one every single one of us can get behind! **       Supporting a Balanced Budget Amendment and only voting for budgets that are in balance.  House Republicans this past year did not produce a balanced budget.  Republicans should always fight for this goal.  Thomas will join Rand in both voting against unbalanced budget plans and in supporting Rand's 5-year balanced budget plan. **       Fighting the out-of-control EPA.  The Obama EPA has declared war on Kentucky coal.  Thomas will join Rand as a strong advocate for repealing Obama's rules and stripping bureaucratic power by passing legislation like the REINS Act, which was sponsored by Rand and the retiring Congressman Davis. **       Protecting our rights by standing up for gun owners and the 4th amendment.  Our government's war on our privacy must stop. **       Fighting for a fairer, flatter tax that lowers tax rates and eliminates tax loopholes for special interests. **       Fighting the special interests in Washington by standing up against wasteful spending. Thomas has already stood up publicly for these things.  He has simultaneously cut taxes, spending, AND debt in his county! Believe me, that is a record that is sorely needed in Congress. Some might still try to tell you that Thomas doesn't have the political experience necessary.  His main opponents are multi-term state legislators and county executives. Well, having spent a good bit of time in Washington myself, I can tell you firsthand - the LAST thing it needs is more professional politicians. It needs more people with real principles, who will stand up and fight. Thomas is absolutely one of those people.  I am sure of it.
